New Smyrna Beach, FL - A prominent local attorney is arrested on a domestic violence charge.

Volusia County Sheriff's Office says they were called to the home of 54-year-old Allan Ziffra - one of the founding members of the Rue & Ziffra law firm - for a domestic disturbance close to midnight last Friday.

According to the report Christina Ziffra, Ziffra's wife, states she entered their bedroom while he was sleeping and turned on a light. She then said when he awoke the two engaged in an argument.

She then said she grabbed his phone and left the bedroom and went to their pool deck where she threw his phone in the pool. Ziffra then locked her out of the bedroom and chased her across the pool deck.

When she attempted to run back into the house, Ziffra grabbed her by the hair and threw her against the wall, which caused a small cut on her shoulder. She states she was then pushed to the ground. She advised she was eventually able to get away from Ziffra and back into the house.

Ziffra told deputies he was woken up by his wife and the two engaged in an argument and that she threw his phone in the pool. He then got his phone from the pool, dried off, and went back to bed according to the report.

He has since been released.

This is Ziffra's second domestic violence arrest.

Ziffra was also arrested back in 2011 by St. Augustine police after he pushed down and punched Shawna Miro, his fiance at the time.

He was not prosecuted for the 2011 charge.
