Texting & Driving Ban Goes Into Effect Today

Daytona Beach, FL - A texting and driving ban that was sent to Governor Ron DeSantis back in May is expected to go into effect today.

And one local police chief is ready for the change.

Daytona Beach Police Chief Craig Capri appeared on WNDB's "Marc Bernier Show" last Wednesday (June 26th) for his regularly scheduled visit and talked about the change that was coming to the state.

That change is House Bill 107 (HB 107), which officially outlaws texting and driving on Florida roadways.

A much needed bill, according to Capri.

"Put the phone down," said Capri. "Go to point A, go to point B, then get on your phone and do whatever you want."

According to Capri, the new law will make texting while driving - or as the bill says "using a wireless communications device" - a moving violation and primary offense that can get drivers a $166 fine and three points on their license.

And some may think that they can still use their phones while they're stopped. But, Capri says that won't be the case either.

Drivers can still be pulled over and cited for texting while driving if they are stopped at a red light, according to Capri.

"If the vehicle is on and you're controlling that vehicle, you have to pay attention at that red light. What if someone comes in front of you at the light and you start rolling and you hit a car," said Capri.

On Monday, drivers should expect enforcement engaged more towards education. Capri said that when the law goes into effect, Daytona Beach will conduct a 30 day "education period" to inform drivers of the new law if they get pulled over for texting while driving.
