Suspect Claims Self-Defense In Shooting Outside Ocean Deck Restaurant In Daytona

Daytona Beach, FL - A shooting happened outside of the Ocean Deck restaurant in Daytona Beach early Saturday morning and the suspect told detectives he shot out of self-defense. Volusia County Beach Safety officers heard the sound of gunfire around 1:30 AM on May 27 and were flagged down for help. They found the victim, 32-year-old James Flournoy, lying in the sand. Flournoy survived his injuries and was brought to Halifax Health Medical Center. Beach Safety and Daytona Beach Police officers interviewed witnesses at the scene and found the suspected shooter, 26-year-old Devin J. Ross, at the Roomba Inn and Suites in Daytona Beach. The gun used in the incident was found and recovered. Beach Safety has charged Ross with carrying a concealed firearm without a permit. The Volusia County Sheriff's Office took over the investigation and interviewed Ross. He told detectives that the incident began when Flournoy, who appeared to be drunk, started yelling and cursing at Ross' girlfriend and her child. Ross confronted him and said the obscenities were unnecessary, then Flournoy attacked Ross. That's when the 26-year-old opened fire. VCSO's investigation is ongoing and no other information is available at this time.
