South Daytona Limits Alcohol Drink Sales To Midnight

South Daytona, FL - A recent spike in noise complaints leads to South Daytona changing the time liquor establishments can sell and serve alcohol.

The second reading of that new ordinance passed during last night's South Daytona City Council meeting. The first reading passed last month.

Any bars or other places licensed by the state to sell alcohol will not be able to do so between midnight and 7 a.m. daily unless the license holder and/or owner gets approval from the city and pay $50 annually for a new permit to extend from midnight to 2 a.m. daily.

Prior to the vote, South Daytona City Manager Joe Yarbrough told the council he hoped the ordinance would stop the complaints and that Police Chief Gerry Monahan was a big help in getting it crafted.

"[Monahan] ushered a similar one through in Port Orange when he was the [police] chief there," Yarbrough added.

Also speaking to the council before the vote, Monahan says all affected businesses in the city will get a hand-delivered packet soon explaining the change, but he doesn't expect it to affect more than a half-dozen businesses.

Those establishments will not be allowed to have anyone inside between midnight and 7 a.m. daily unless the special permit is in place, according to the ordinance.

The new rules also require businesses to "take all necessary steps to minimize the negative impacts that their establishment may cause in nearby residential or commercial neighborhoods or on [City of South Daytona] resources."

Violators face the possibility of fines and loss of liquor license.

Sales of packaged alcohol will still be allowed in the city except between the hours of 2 a.m. and 7 a.m. daily.
