State Attorney Clears Officers Involved In August Shooting

Daytona Beach, FL - Seventh Judicial Circuit State Attorney R.J. Larizza says after investigation, Daytona Beach Police officer Dominic Besse and Holly Hill Police officer Luis Lugo,  no further action is warranted by this office. The officers were involved in the fatal shooting of 44-year-old Michael Harris on August 29, 2020.

Attempted Murder Suspect Killed, Officers Injured In Holly Hill Shooting.

The state attorney's letter to the Florida Department of Law Enforcement said that after review of investigative reports, officer
statements, and witness statements, "no further action is warranted by this office." 

Both Holly Hill and Daytona Beach police responded to an apartment on Espanola Avenue in Holly Hill because they had received an anonymous tip that was where Harris was located. He was wanted for reportedly shooting a woman twice in the back. 

Daytona Beach Police Chief Craig Capri, now retired, said at the time, "We didn't dictate that, the suspect dictated that. The suspect fired at officers first and we defended ourselves. If you pull a gun on a police officer and shoot a police officer, you're going to be killed. It's as simple as that."
