Man Charged With Aggravated Battery With A Golf Club

New Smyrna Beach, FL - A New Smyrna Golf and Country Club employee is recovering after being attacked by 50-year-old David Foster, who hit him multiple times with a golf club. The employee refused all medical treatment despite a laceration on the back of his head that was bleeding heavily. He also had a large contusion on his left arm that he states resulted from being hit with the golf club.

The victim said he was trying to shut down the club around 8 p.m. yesterday (June 15) when he made contact with Foster and told him that he needed to leave. He said Foster tried to drive out of the course at the wrong exit so directed him to the correct exit. The victim said Foster became aggressive at that time, getting in his face and yelling and screaming at him. He told Foster that he was going to have him trespassed from the club. According to the victim and a witness, Foster grabbed a driver from his golf club bag, then hit the victim in the head with it. The victim fell to the ground while Foster kept hitting him. The witness said that Foster hit the victim no less than 10 times. The victim claims Foster then stated, "I was going to jail anyway for a warrant, I might as well kill you".

Police officers then interviewed Foster who appeared to be intoxicated, having trouble keeping his balance, and slurring his words. Foster admitted he did it and said he did not wish to speak further. According to the report, "Foster then continued by spontaneously uttering he felt as though he was being trapped within the golf course by the victim. Mr. Foster also stated he suffers from post-traumatic stress disorder. He went on to state that the victim challenged him to a fight prior to telling him that he was being trespassed. He stated that he was teaching the victim a lesson swinging his golf club at him multiple times. Foster also stated that he believes the laceration on the back of the victim's head was a result of him falling on the ground, not being hit with his golf club."

Officers found the broken golf club at the scene. Foster was placed under arrest for aggravated battery. He was taken to the Volusia County Branch Jail and has since bonded out on a $10,000 bond.
