FCSO Says Man Attacked Others Over His Batman Jacket

Palm Coast, FL - Charges have been forwarded to the State Attorney's Office in relation to an incident that happened at a Palm Coast McDonald's last night (January 21).  Flagler County Sheriff's deputies have identified 23-year-old Ldarius Smith as the suspect. The victims told them that Smith attacked them after one gave him a compliment on the Batman jacket he was wearing.

The victims, two men, said Smith walked past them  and one of them told Smith he liked his jacket.  Smith yelled obscenities at the men and gave them the finger. The men said they decided to ignore the outburst but Smith wouldn't let it alone. They say he went outside and videoed them while they were sitting at a table.

The victims say Smith was standing by their truck in the parking lot. They went out to tell him they were calling 9-1-1. This caused Smith to get even angrier. He went to his vehicle, pulling out a pinkish-orange baseball bat  The victims say Smith was swinging the bat continuously, stopping just short of hitting them. An unseen woman in  Smith's car yelled to the men to leave the area, which they did. As they pulled away, Smith threw a nickel at the driver, hitting him in the head with and causing an abrasion.

The victims were shown a photo lineup separately. They both chose Ldarius Smith as the man who had accosted them. The charges being brought against him are Battery and two counts of Aggravasted Assault.  

At this time, no further action is being taken.
