Deputies Investigating Fatal DeBary Shooting

UPDATE (4:10 P.M.): The Volusia Sheriff's Office has identified the deceased as 40-year-old Roberto Miguel Ovalle of Deltona.

UPDATE: The suspect in the shooting, identified as 48-year-old Julio Rivera, is now charged with first-degree murder in the shooting death of a 40-year-old Deltona man he had known since childhood. The victim's girlfriend told deputies that Rivera shot her boyfriend in the head while the three of them were sitting inside storage unit #12, which is where Rivera has been living.

The girlfriend told deputies that she fled the unit after the shooting but Rivera followed her and got into her car, saying that he would protect her and her children. She took Rivera's gun from him and went to get her children. He left and went back to the storage facility. When he got there, deputies were waiting for him.

Investigators believe Rivera had been staying at the storage unit since October,  in an effort to avoid arrest on a warrant for a previous murder conviction in New York.  Rivera is charged with first-degree murder in this case and violation of probation on the warrant out of New York. 

Other charges could be pending as deputies found a  significant amount of marijuana (about 20 vacuum-sealed bags), as well as an unknown white powder and unknown brown substance, were recovered from the storage unit.

Rivera is in the Volusia County Jail being held on no bond.

Not much is available in the way of information at this time, other than the following.

Deputies were called to 333 East Highbanks Road around 7:15 p.m. last night (December 8th) with reports of a shooting. Once on the scene, law enforcement found a deceased male.

As previously stated, no other information is available. This story will be updated once more details are released.
