Deltona, FL - Attempted second-degree murder charges have been filed for a Deltona man accused of shooting his daughter’s ex-boyfriend multiple times.
Todd Powers was also charged with possession of a weapon or ammunition by a convicted felon and discharging a firearm in public following the incident that landed the man in the hospital in critical condition.
The Volusia Sheriff’s Office says a 911 call is what brought deputies to the home on Waterman Street Thursday morning (March 3). When they arrived, they found the man lying in the driveway with multiple gunshot wounds. The preliminary investigation so far shows that the man came to the home to see his ex-girlfriend, because they’re still friends. But when he arrived he made contact with Powers and her brother, which led to a verbal altercation.
The brother claims the argument became physical when the victim punched Powers and he punched back before they fought on the ground. However, deputies say they did not find any injuries to either person—besides gunshot wounds—and there were no signs of a struggle or a fight. When the fight ended and the two separated, the brother went inside.
Just minutes later, multiple gunshots rang out. After a brief pause, more shots were fired. In fact, some of the shots were heard on the 911 call that was placed, along with the sound of a man yelling “I don’t know what he thought was going to happen.”
At this point, evidence, statements, and footage gathered by deputies determined Powers fired at the unarmed victim several times over the span of several minutes, during which Powers was not under threat. He now remains in the Volusia County Jail on $126,000 bond.
A records check with the Florida Department of Corrections shows Powers was originally imprisoned on felony battery and cocaine possession charges in 2002. He was released from prison in 2003.
The victim remains in critical condition as of Thursday evening.
