Child Porn Suspect Out On Bond Back In Jail

New Smyrna Beach, FL - A 62-year-old Port Orange man already facing 21 charges of Possession of Child Porn is back in the Volusia County Jail with his bond revoked. New Smyrna Beach Police found Scott Stewart on Wednesday, (June 24) sitting in his car near the off-beach parking area and beach access ramp where children are present in Grayce K. Barck North Beach Community Park.

During his contact with police, Scott Stewart was naked, only wearing a ball cap and a towel over his lap, with no other clothing. He told police that he was looking for his cat but a witness reported they'd seen a number of times, appearing to watch children in bathing suits. Stewart's pre-trial release conditions include him having no contact with children,

The Volusia Sheriff's Office, who'd arrested Stewart as part of 'Operation Cyber Guardian' on January 9, 2020,  and NSBPD coordinated with the State Attorney's Office to get a warrant to revoke Stewart's bond. He was arrested yesterday (June 25) at his home while mowing the lawn.

During the motion to revoke the bond yesterday, Stewart's lawyer made the argument that it is pure speculation on whether Stewart was naked under the towel because the officer did not look or ask him to lift the towel. He also argued that his client had not violated any condition of his bond. The judge did not agree and Stewart remains in the Volusia County Jail being held without bond.
