DeLand, FL -Update: During the hearing, Toledo's attorney said he didn't know about the motion until after it had been filed. He requested the motion be abandoned and Judge Zambrano granted that request.

Triple murder suspect Luis Toledo's case will be in court this afternoon for a hearing on his motion for a speedy trial. Toledo may be trying to force his case to go to trial before the Florida Supreme Court can rule on the state's death penalty. The U.S. Supreme Court suspended the Florida death penalty after finding the process was unconstitutional.
Toledo, a Deltona resident, is charged in the murders of his wife and her two small children. The bodies of the three have never been found. 28-year-old Yessenia Suarez, 9-year-old Thalia, and 8-year-old Michael disappeared in October 2013 from their Deltona home.
