Port Orange, FL – A Port Orange man in familial custody of his alleged juvenile victim is now facing charges of sexual battery.
On February 19, a 40-year-old male, whose name is not being released so the identity of the victim is protected, was arrested and charged with two counts of sexual battery upon a person 12 years of age and older, but younger than 18 years of age.
On February 16, officers made contact with the victim’s mother and the person who reported the abuse. According to the incident report, the victim’s mother said her daughter told her the day before that the defendant had “been doing things to her.”
The victim said that he had been having sex with her once a week for three years in both Port Orange and where they had previously lived. The victim also said sex was sometimes used as punishment.
According to the report, the defendant consented to evidence collection and denied the accusations against him.
