Ormond Condo Owner Arrested After Shooting Tenant’s Hand During Fight

Ormond Beach, FL – According to the Volusia County Sheriff’s Office, an argument over an Ormond condo caused an owner to shoot a tenant in the hand.

At around 4:41 PM on Monday evening, VCSO deputies arrived at the condos located at 1510 Ocean Shore Blvd. in response to the owner’s complaint about one of his tenants. The owner, Gary W. Moore, 60, claimed that his tenant, Jorge Martinez, 39, did not comply with his end of the deal that stipulated Martinez could live in the condo only if he helped renovate it.

Moore decided that he wanted Martinez to move out immediately and Deputies advised Moore that he had to go through the civil eviction process since Martinez had started to renovate the property. Moore then decided to put all of Martinez’s belongings into the hall and lock the door.

On Monday at 6:32 PM, a VCSO deputy arrived back at the condo to help Martinez gather his dogs that were loose. Martinez told the deputy that he had paid rent for that month, but the deputy reminded him that it was a civil issue and to call the VCSO if he needed help.

Upon leaving, the deputy saw Martinez break the glass window of the condo to try to get in. Suddenly, there was a gunshot and the deputy ordered Martinez come back only to see that Martinez had been shot in the left hand.

Martinez was taken to Halifax Health Medical Center with non-life-threatening injuries. The VCSO and the Ormond Beach Police Department set up a perimeter around the condo and shortly thereafter, Moore peacefully surrendered.

Moore was charged with aggravated battery with a deadly weapon and possession of a firearm by a convicted felon after the VCSO investigated the incident. In Texas in 1978, Moore was convicted of aggravated assault with a deadly weapon. On Tuesday, Moore remained in the jail, held on a $20,000 bond.
