Deland, FL – A date ended badly for a Deland man when he went into his girlfriend’s home and had another man confront him at gunpoint.
VCSO deputies arrived at the home on Sago Cir. around 2:37 AM on Wednesday in reference to an alleged aggravated assault. The victim told deputies that he was visiting his girlfriend at her home when an unknown man came into the house without saying a word. The man, later ID’d as 28-year-old Luis Rivera-Delgado from Deland, then took out a dark firearm and struck the victim in the chin with the weapon. Delgado then pointed the gun in his face and threatened to kill him if he didn’t leave.
The victim told deputies he didn’t know Delgado and was scared for his girlfriend’s safety. He told deputies this was the first time he had been invited into her home and wasn’t sure if Delgado lived there with her.
Deputies did see redness near the victim’s chin. A perimeter was set up around the house and deputies made announcements using a PA system asking for everyone to exit the home. After about 30 minutes, the woman came out and spoke with VCSO.
Delgado came out after another 30 minutes.
The victim told deputies he recognized Delgado with 100% certainty as the suspect and completed a sworn statement saying he wished to pursue criminal charges.
Deputies interviewed the girlfriend who said Delgado’s weapon was actually a BB gun, but she wasn’t sure where he hid it. She gave deputies permission to search the home, and Delgado said he hid it in a shoe in a closet in the master bedroom. Deputies found the BB gun and collected it as evidence, took pictures of the scene, and based on statements and evidence determined there was probable cause to arrest Delgado for aggravated battery with a deadly weapon and aggravated assault with a deadly weapon.
He was transported to VCBJ and is being held on $20,000 bond.
