Daytona Beach, FL-Michael Pastore, known as an advocate for the local homeless population, is charged with battery in an incident Saturday in Daytona Beach. The 61-year-old is charged with a misdemeanor. Police say officers went to 1118 Jacaranda Avenue for a report of a fight with injuries between two men around 5:30 PM. When officers arrived, the two men told them they had both been exposed to pepper spray during the alleged incident. Police found out that one of the men, identified as 57-year-old Harold Blue, lived at the residence with 51-year-old Dale Bellamy and the two had dated in the past. Blue told police Bellamy had told him she was coming to the residence to get her belongings. Pastore told officers he and Bellamy had been dating. Blue told police the encounter became physical when he told Pastore several times to leave the residence. Pastore reportedly refused to leave. Blue told police he saw Pastore reach toward his hip and thought he was reaching for a knife. That's when Blue said he grabbed his cellphone and called police for help. Blue says that's when Pastore allegedly sprayed him with pepper spray and chased him around the home. Blue said when he fell down near the door, Pastore kicked him. The police report says Blue had bruises and scratches on his body. Pastore's only evidence of what happened, according to police, was pepper spray residue.
