Osteen, FL - Charges are pending against a 23-year-old Lake Mary man in a fatal crash in Volusia County last night (April 4th).
The Florida Highway Patrol says it happened just after 7 o'clock on Lemon Bluff Road near Wild Acres Road in Osteen.
Troopers say Joshua Montes de Oca was hauling a boat when he lost control of the 1996 Toyota pickup he was driving and the truck flipped over.
A passenger in the truck - 22-year-old Andrew Malki of Lake Mary - was partially ejected and died at the scene.
The FHP report shows Malki wasn't wearing a seat belt at the time and that Montes de Oca was.
Montes de Oca had minor injuries and was transported from the scene to Central Florida Regional Hospital in Sanford.
Troopers say it isn't clear at this point if alcohol or drugs are a factor in the crash. No other vehicles were involved.
