UPDATE (05-21-18): DeLand PD have charged 19-year-old Victor L. Franklin Jr. of Orange City with felony aggravated battery with a deadly weapon in connection to this incident. He’s being held on $20,000 bond at Volusia County Jail.

Officers say the 14-year-old victim has left Halifax Health Medical Center and that Franklin is the victim's cousin.

According to the arrest report, a witness inside the home told DeLand PD the shooting happened in a bedroom. The report also shows that Franklin was arguing with the victim about a glove and that Franklin pointed the gun at the victim's head just before he was shot in the chest.

The victim told police Franklin had pointed a gun at him a few days earlier during an argument about a cigar.

Franklin's parents turned him in to police after he fled from the scene and he denied threatening his cousin over a glove or a cigar, per the arrest report. He claims he was showing the gun to his cousin and it went off.
