Volusia County, FL-In Volusia County, 15.8 miles out of 34.8 miles on the beach are drivable. a lawsuit trying to keep that amount from decreasing has been denied. The group "Let Volusia Vote" lost an appeal today in court.
The appeal to press a lawsuit against the Volusia County Council over three ordinances establishing a 1.2 mile no driving zone on the beach, will not move forward. That was the ruling from the 5th district court of appeal on Tuesday.
A local group, Let Volusia Vote, had filed the lawsuit. According to the suit, the county violated its own charter, which calls the right of beach access "a public trust."
