Man Charged With Public Nudity At The Peabody Auditorium

Daytona Beach, FL - A 21-year-old Sebring man who posted a picture of himself with his pants down in front of the Peabody Auditorium is now charged with Public Nudity. Daytona Beach Police investigators were able to identify Brock Barnicle through his social media accounts where he posted the picture.

DBPD says the incident occurred Sunday (September 6) around 11 p.m. The incident report states that Barnicle was in a small garden on the northwest corner of the Peabody. He was less than five feet from a public sidewalk, and less than 25 feet away from the public road. 

Investigators say that Barnicle pulled his pants down, exposing his buttocks more than what the legal description of exposing your buttocks allows. The report further states that the suspect faced the anatomically correct angelic figurines in the garden and positioned himself so that it would "appear as if he was holding his penis." 

The photograph taken was posted on Barnicle's TikTok, Facebook, and Instagram accounts. Captions posted from the suspect's social media stated he was the person in the photograph and that he may get arrested for it, but that it was worth it.

Investigators spoke with Barnicle yesterday (September 10) by telephone. He admitted that he was the person in the picture. He said that he was with a large group of people in the parking lot when he decided to go into the garden and have the picture taken. The incident report states that he apologized for his actions, saying that it was a prank and that he did not intend for it to get so much attention. 

The photo has since been removed from Barnicle's social media accounts.
