Daytona Beach, FL - A 12-year-old is facing three felony counts after he pointed a stolen gun with a laser sight at various people.

The Daytona Beach Police Department says Damarion Moore was arrested at the John H. Dickerson Community Center after a witness called for assistance Tuesday night (October 22nd).

When officers arrived around 7:30, they found Moore, also known as "Lil North" or "Lil Northside," near the basketball courts. The witness told police they saw Moore pointing a loaded firearm with a laser sight at other children near the basketball courts.

Moore was taken into custody after authorities learned that he was in violation of a court-ordered curfew. A search turned up a spent brass casing inside of one of Moore's pockets, which he claimed he found at an intersection.

An officer searched the intersection and discovered a loaded semi-automatic pistol stashed underneath a dumpster. That same weapon was reported stolen three days prior in Daytona.

Security footage from the Dickerson Center shows Moore running from the basketball courts to the dumpster before officers arrived on the scene. The ammunition found in the gun also matched the brass casing found in his possession.

Moore - who has gang ties according to DBPD - is facing charges of possession of a firearm by a minor, grand theft of a firearm and a probation violation. Moore is currently on five years' probation for grand theft, a crime he committed when he was 10-years-old.

The following day (October 23rd), Daytona Beach police were made aware of another incident involving Moore and a gun at Campbell Middle School, where he is a student.

According to the victim's guardian, Moore pointed a gun with a laser sight at that child during an argument over basketball around 4:15 that afternoon, just three hours before his arrest in the other unrelated incident.

The guardian claims Moore pointed a gun at them and fired a bullet in the air after he confronted Moore at the Dickerson Center about the earlier incident at Campbell. The guardian then fled the scene.

Campbell administrators were informed about both incidents, prompting them to contact DBPD for further investigation.

The guardian is refusing to press aggravated assault charges against Moore on the child victim's behalf as well as themselves.

Moore is currently in custody at the Volusia County Department of Juvenile Justice. He's held without bond.
